EXPLANATORY MEMORANDUM

The common transit Convention of 20 May 1987 establishes the measures facilitating the movement of goods between the EC and the EFTA countries.

The accession of the Czech Republic, the Republic of Estonia, the Republic of Cyprus, the Republic of Latvia, the Republic of Lithuania, the Republic of Hungary, the Republic of Malta, the Republic of Poland, the Republic of Slovenia and the Slovak Republic to the European Union involve, on the one hand, a reorganisation of the linguistic references in the Convention following their transfer from the EFTA part to the European Community part, and, on the other hand, the introduction of new linguistic references for the newly acceding.

In addition, the taking into account of all the hypothetical cases relating to the guarantees and to the guarantee waivers requires their inclusion by means of a code, using a single character, which becomes alphanumeric owing to the number of cases. This new coding involves the modification of the corresponding data groups used by the New Computerisation Transit System

Finally, a transitional period for the use of the guarantee documents used in transit was judged necessary in order to allow for both operators and national administrations not to stop the transports commenced out before accession and ending at a subsequent date, by using these documents subject to certain conditions.

This is the object of the draft decision n° 1/2004 of the EC-EFTA Joint Committee. This draft decision received the favourable opinion from the EC-EFTA Working group on Common Transit.

This draft decision is submitted to the Council in order to establish a common position with a view to its final adoption by the EC-EFTA Joint Committee 'Common transit' byway of the written procedure.


Draft DECISION No 1/2004 OF THE EC-EFTA JOINT COMMITTEE ON

"COMMON TRANSIT" amending the Convention of 20 May 1987 on a common transit procedure


THE JOINT COMMITTEE,

Having regard to the Convention of 20 May 1987 on a common transit procedure, and in particular Article 15(3)(a) thereof,

Whereas:

(1) The Czech Republic, Estonia, Cyprus, Latvia, Lithuania, Hungary, Malta, Poland, Slovenia and Slovakia are to accede to the European Union.

(2) Accordingly, the Czech, Estonian, Latvian, Lithuanian, Hungarian, Maltese, Polish, Slovenian and Slovak language versions of the riders used in the Convention should be inserted in the Convention in the appropriate order.

(3) In order to take into account all the situations relating to guarantees and guarantee waivers, it is necessary to provide for these situations by mean of codification which needs to be alphanumeric owing to the large number of the situations.

(4) Because of the introduction of alphanumeric codification of the guarantee codes, data concerning the New Computerised Transit System needs to be amended.

(5) The application of this Decision is bound to the date of accession of new Members States to the European Union.

(6) In order to allow the use of guarantee forms printed in accordance with the criteria in force prior to the date of accession of the new Members States to the European Union, a transition period should be established during which the printed form, with some adaptations, should be used.

(7) Therefore the Convention to be modified accordingly.

HAS DECIDED AS FOLLOWS:

Article 1

The Convention on a common transit procedure is amended as follows:

1. Appendix I is amended as set out in Annex A to this Decision.

2. Appendix II is amended as set out in Annex B to this Decision.

3. Appendix III is amended as set out in Annex C to this Decision.

Article 2

1. This Decision shall apply from 1 May 2004.

2. The forms based on the specimen forms in Annexes B1, B2, B4, B5 and B6 to Appendix III may continue to be used, subject to the necessary adaptations to the geographical and residential references, until stocks are exhausted or until 31 December 2004 at the latest.
