POLICE MISSION IN BOSNIA AND HERZEGOVINA (EUPM)

    SITUATION

The mandate for the UN Mission in Bosnia-Herzegovina (BiH) including the International Police Task Force (IPTF) will expire on 31 December 2002 and will not be renewed. Remarkable achievements have been made in developing the police forces in BiH since the conclusion of the General Framework Agreement for Peace in BiH (GFAP) in December 1995. According to the UN estimations, the goals foreseen in the Mandate Implementation Plan (MIP), designed to establish basic police competence and integrity in a post conflict society, will be

achieved by the end of 2002.

Regarding these police achievements and in accordance with UN criteria the situation at the end of 2002 is expected to be as follows:

• The post war police force of 40,000 will have been reduced to about 20,000 certified police

officers. Within this number the newly created State Border Police (SBS) is expected to raise its level to approximately 2,400 officers and the State Information and Protection Agency

(SIPA) should reach the strength of about 500 officers.

• All police will have had basic training and some will have specialist training. They will

work in an accountable and transparent civilian police structure and be provided with a minimum level of equipment.

• Local riot control and anti-terrorist police units will have been established and fully trained.

• The institutions and mechanisms for internal and regional police co-operation and for

progressively increasing the multi-ethnic composition of police will be ongoing.

Nevertheless, there is a common recognition among the different actors involved that a successor Mission will be necessary to ensure long-term sustainable results. The end-state that will be achieved under the UNMIBH/IPTF mandate will not be the end-state in which the International Community should leave the police forces of BiH.

    Political Objectives.

    The Stabilisation and Association Process (SAP) set out in June 1999 1 , offers the countries

    of the Balkan region the prospect of integration into European structures. The 24 November 2000 Zagreb Summit set the seal on the Stabilisation and Association Process (SAP) by gaining the Region's agreement to a clear set of objectives and conditions. In return for the EU's offer of a prospect of accession on the basis of the Treaty on European Union (TEU) and the 1993 Copenhagen criteria, the countries of the Region

undertook to abide by the EU's conditionality and use the SAP as a means to begin to

prepare themselves for the demands of the perspective on accession to the EU.

The desirable political end-state for the future of BiH is a State no longer reliant on the

International Community and donor assistance assuming transfer of ownership, serving its

citizens according to democratic principles, meeting its international obligations and

integrated fully into European institutions. Some of the measures to achieve these goals

are the development of effective and independent institutions, in particular at the State

level, and the affirmation of the Rule of Law.

The main political pre-condition for success will be the necessity of a clear and strong political will of the three constituent peoples to accept that BiH can only move towards European integration in the framework of a unified, stable, multi-ethnic and functional

State and their commitment to work together for its development and improvement.

In accordance with the GAC conclusions of 18/19 February 2002 and the Joint Action on EUPM of 11 March 2002, the EU Police Mission (EUPM) should contribute to the overall peace implementation in Bosnia and Herzegovina as well as to the achievements of the EU overall policy in the region, notably the Stabilisation and Association Process. The EUPM, as part of a broader rule of law approach, should help to create an independent police institution that, with full respect of Human Rights, provides the necessary security to the

society they serve and doing so to facilitate the development of the State.

    MISSION

The EUPM, supported by the European Commission’s institution building programmes will aim, as part of a broader rule of law approach and in line with the general objectives of Annex 11 of the Dayton Agreement, to establish sustainable policing arrangements under BiH ownership in accordance with best European and international practice, and thereby raising

current BiH police standards.
