Subject : Summary of discussions

  • 1. 
    Adoption of the agenda

    The agenda as set out in CM 2177/1/08 REV 1 was adopted.

  • 2. 
    Fourth round of mutual evaluations - Discussion of the Report on Malta

    9617/08 CRIMORG 75 COPEN 97 EJN 38 EUROJUST 49 RESTREINT

    The evaluation team presented the report. The Maltese delegation commented on the findings

    of the evaluation team and replied to the questions posed.

    The chair concluded a revised version of the report would be presented to the next MDG

    meeting.

    Fourth round of mutual evaluations - Adoption of the Report on Austria

    The report was adopted.

  • 5. 
    Fifth round of mutual evaluations - Choice of topic

    The MDG confirmed the topic of financial investigations and financial crime for the 5th Round of mutual evaluations.

    The Chair indicated that the remarks made by delegations regarding the description of the topic would be taken into account in the questionnaire, which would be the basis for the

evaluations of the 5th Round and which would be presented at a future MDG meeting.

  • 6. 
    Implementation of the Convention on the protection of the European Communities' financial interest and its protocols - Article 10 of the Convention

    Commission Staff Working Paper Annex to the Second Report from the Commission - Presentation 6744/08 DROIPEN 15 FIN 69 + ADD 1

    The Commission gave a detailed presentation of the findings of the report. It also invited those Member States identified in the report because of lacking or incorrect implementation of the Convention on the protection of the European Communities' financial interest and its protocols, to present their views on the Commission findings. A short exchange of views with some delegations ensued.

    Periodic proactive analysis of the necessary EU coordination efforts regarding multilateral negotiations in international fora in criminal matters

    Delegations welcomed this initiative of the Presidency as well as the general structure of the document. A number of detailed comments were provided with regard to the table, of which the Chair indicated they would be taken into account for a future version of the document.

    • Outcome of proceedings of the meeting of EU CATS - Interpol Troika

      The chair briefly presented the main topics which were discussed at this meeting, which took place on 16 May in Brussels. The outcome of proceedings that meeting can be found in 10050/08 JAI 280 RELEX 378 ENFOPOL 104 CRIMORG 82.

    • Room document from the Commission services on the Report [COM(2007) 827 final i] on the implementation of the Council Decision of 17 October 2000

      concerning arrangements for cooperation between financial intelligence units of the Member States in respect of exchanging information (2000/642/JHA)

      Delegations provided detailed comments on the four questions set out in the Commission room document.

    • Information from the Presidency on Data Exchange in 3rd Pillar: - Outcome of the 3rd Expert Meeting on the Swedish Framework Decision (Brussels, 3 - 4 June 2008)

      The chair briefly presented the main topics which were discussed at this meeting, which took place on 3-4 June in Brussels. The Spanish delegation distributed a working document concerning the concept of coercive measures under the Swedish Framework Decision.

  • Ad Hoc Group on Information Exchange

    The chair informed delegations of the Coreper decision to set up this group. The

    meeting dates for the rest of the year were announced.
