Subject: EU - Mongolia: Protocol to the Framework Agreement on Partnership and Cooperation - Accession of Croatia

    On 29 May 2015, the Commission submitted to the Council a proposal for a Council Decision on the signing, on behalf of the European Union and its Member States, of the Protocol to the

    Framework Agreement on Partnership and Cooperation between the European Union and its Member States, of the one part, and Mongolia, of the other part, to take account of the accession of the Republic of Croatia to the European Union , as well as the text of the draft Protocol to the Framework Agreement as set out in docs. 9446/15 + ADD1. At the same date, the Commission submitted to the Council a proposal for a Council Decision on the conclusion of the Protocol (doc. 9469/15 + ADD1).

    In accordance with the second subparagraph of Article 6(2) of the Act of Accession of the

    Republic of Croatia, the accession of the Republic of Croatia to agreements signed or concluded by the European Union and its Member States is to be agreed by means of a Protocol to those agreements.

    On 6 June 2016, the Council adopted the Council Decision on the signing, on behalf of the

    European Union and its Member States, of the Protocol to the Framework Agreement on Partnership and Cooperation between the European Union and its Member States, of the one part, and Mongolia, of the other part, to take account of the accession of the Republic of Croatia to the European Union 1 , and decided to request the consent of the European Parliament, on the basis of the draft Council Decision on the conclusion of the Protocol as set out after finalisation by the Legal/Linguistic experts in document 9264/16.

    The Protocol was signed on 31 October 2016 in Brussels.
  • 5. 
    Consent by the European Parliament was given on 16 May 2017.
  • 6. 
    The Asia-Oceania Working Party reached agreement on the draft Council Decision in question on 22 November 2017.
  • 7. 
    The Permanent Representatives Committee is accordingly invited to recommend that the

    Council at one of its upcoming meetings:

    − adopts as an 'A' item the Council Decision on the conclusion, on behalf of the Union and its Member States, of the Protocol to the Framework Agreement on Partnership and Cooperation between the European Union and its Member States, of the one part, and Mongolia, of the other part, to take account of the accession of the Republic of Croatia to the European Union, as contained in J/L document 9264/16, together with the

Protocol to the Framework Agreement as contained in J/L document 8940/16.

    It is recalled that the Protocol would enter into force on the first day of the month following the date of the deposit of the last instrument of approval, but not before the date of entry into force of the Agreement 2 .

November 2017, the procedure provided for in Article 63.1 of the Framework Agreement having been completed on 9 October 2017.
