Statement by the Federal Republic of Germany for the minutes of the meeting deciding on adoption in the Transport Council of the General Approach on the proposal for a Regulation
on streamlining measures for advancing the realisation of the trans-European transport
network
Germany assumes that the procedural acceleration provisions contained in the present proposal aim only to regulate the course and the formal organisation of the relevant procedures, and are without prejudice to the substantive criteria arising from the requirements of substantive law.
Germany assumes, in particular, that the basic four-year time limit for completing permit-granting procedures, set out in Article 6(1) of the draft General Approach, neither requires nor may be used to justify, in the context of either the transposition of the Directive into national law or the application of national law in compliance with the Directive, any substantive limitation of the scope of assessment with regard to environmental protection requirements or any lowering of the criteria for carrying out such an assessment when taking an authorising decision.
